Today, let’s talk about return and refund policies, which can be a little tricky depending on where you are located. In the U.S, there’s no federal law requiring stores to accept returns, so each business sets its own rules. but when those rules aren’t clear, it can lead to legal issues—like in the Hines v. Overstock case, where a vague return policy got overstock sued. The lesson? businesses need to make their return conditions crystal clear.In the European Union, things are different. The consumer rights directive gives people a 14-day window to return online purchases for any reason. If the seller doesn’t inform the buyer of this right, return can be extended up to 12 months! it’s a much stronger system that pushes companies to be transparent and consumer- friendly.In Nigeria, return policies are evolving. The Federal Competition and Consumer Protection Act (FCCPA) of 2019 makes provisions for buyers to return faulty goods, and request for refunds, but outside of that, the rules are still developing. Online retailers, like Konga and Payporte are adopting clearer policies, but enforcement can be inconsistent.For businesses, the key is to be transparent. Make return policies easy to find, offer reasonable time frames, and be clear about which items can’t be returned. On gaffes in governing law clauses.Spotted on an online retailer's website, in its terms of service¹ (h/t to Theodore Goh for highlighting this):"SECTION 18 - GOVERNING LAWThese Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of 420 NORTH BRIDGE ROAD, #06-27 SINGAPORE SG S188727."I have so many questions.1️⃣ Is 420 North Bridge Road a micronation?² If so, is it a federation,³ with each unit having the right to make its own laws? Or is it only unit #06-27 that has declared itself to be a micronation, and is surrounded by neighbours who accept the jurisdiction of the Republic of Singapore?2️⃣ What are the laws of 420 North Bridge Road, #06-27 (the "Jurisdiction")? Do they mirror Singapore law? And in the context of the terms of service being those of an online store, do the laws of the Jurisdiction require offer, acceptance, and consideration?⁴ And is Chwee Kin Keong v Digilandmall.com Pte Ltd⁵ good law in the Jurisdiction?3️⃣ Unfortunately, the terms of service do not contain any jurisdiction or arbitration clause.⁶ So would Singapore Courts be the appropriate forum for the resolution of any dispute?⁷ Who are the experts who can give evidence⁸ on the laws of the Jurisdiction?⁹ And would it be necessary to apply for such experts to give video-link evidence?¹⁰--As usual, #footnotes in comments.#disputeresolution #onlineshopping #notlegaladvice

EuroCommerce believes that this can only be a success when we make #repair the most attractive option for #consumers and #businesses."Our main recommendations are:1.Ensure legal certainty for businesses by maintaining a link with reparability requirements in EU law2.Access and availability to spare parts needs to be proportionate, sustainable and safe3.We support the European Parliament's proposal for member states’ measures to promote repair4.Do not further fragment the single market and create new barriers to online trade by diverging legal guarantees after repair – harmonise at 6 months5.Consumer should not go directly to the producer for repair but to the seller. Kakao Mobility has been fined 72.4 billion won ($54.93 million) by the Fair Trade Commission (FTC) for abusing its dominant market position. The FTC found that Kakao forced four rival taxi-hailing services, including Uber Taxi and Tada, to share real-time taxi operation data, threatening to block their drivers from receiving calls unless they complied. This action was deemed an illegal use of market power.By the end of 2022, Kakao Mobility commanded a 96 percent market share, classified as monopolistic by the FTC. Chairman Han Ki-jeong underscored the severity of the violation, noting the company's unfair access to competitors' confidential business information for its strategies. The breaches spanned from May 2021 to September 2024, during which Kakao Mobility generated sales of 1.4 trillion won. The imposed fine is 5 percent of the company's sales, making it one of the largest penalties for market dominance violations.Kakao Mobility plans to contest the fine through an administrative court suit, arguing it has not violated any laws. The company asserts its cooperation with rivals aimed to improve user experience and did not exploit the information gathered for its benefit. Despite its defense, Kakao Mobility expressed regret for any concerns raised among customers due to the sanction.
